  1. Terms of Service

    Welcome! We’re happy to have you here, and hope you find Campture delightful to use. Campture is a one stop shop for travellers and adventure enthusiasts. We help the travellers with writing, creating, and sharing of interesting stories as well as providing an online platform for Users to post their boarding pass and photos related to their travel experiences along with booking trips.

    This is a contract between you and Campture ( "we," ,"our," or "us"), applicable when you use our sites, services, mobile applications and content provided by Campture, globally, in existence now or in the future. Please read these Terms carefully; by using Campture, you agree to be bound by them.

  2. Entire Agreement

    These Terms and our Privacy Policy constitute the entire agreement between you and Campture. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be in full force and effect.

  3. Content

    What you see on Campture may be protected by one or more laws regarding intellectual property. You’ll find a few different types of material on our service, so let’s break it down.

    • Campture’s Service, Products, and Brand
      • Our service and products are protected by copyright, trademark, patent and other laws. Campture gives you a personal, worldwide, non-assignable license to use the software we provide you for your own personal, non-commercial use. This license lets you use Campture solely as permitted by these Terms.
      • Unauthorized use of any of Campture’s trademarks, logos, domain names or other distinctive brand features is prohibited.
    • Service Use Guidelines
      • You promise to use the service only for lawful purposes, and to not violate the rights of third parties. Our Community Guidelines, which are part of these Terms, contain more information about acceptable and unacceptable uses of the service. Any unacceptable use, including posting or collecting content that is obscene, pornographic, gory, illegal, threatening or harassing, excessively violent or promoting the harm of self or others, may result in immediate termination of your account and suspension of service access in the future.
      • Content that promotes pirated copies of ebooks, software packages, music, movies, games, etc and is generated by computers, including randomly generated blogs, blogs that re-publish press releases, MARKETING material, search engine results, link dumps or any other mass-produced content is not allowed on Campture.com and the mobile applications of Campture.
    • Your Content
      • You can post your own content on Campture, including articles, photos, comments and other content.
      • You—and you alone—own the rights to the content you create and publish through Campture. By posting it, you give us permission to use your content to do what we reasonably believe necessary to provide our service both now and in the future including storing, displaying, reproducing and distributing your content. This might also include promoting your content with partner companies or services for broader broadcast, distribution or publication via Campture.
      • You’re responsible for the content you publish through Campture and assume all risk associated with it, including anyone else’s reliance on its accuracy or legal claims that might stem from publication. By posting content on Campture, you represent that you have the necessary rights to publish that material, and that doing so doesn’t conflict with any licenses you may have granted to others.
      • We don’t pre-screen anyone’s content. However, we have the right to review and remove or disable access to any content through Campture for any reason. We assume no liability for anything that you or anyone else publishes through Campture.
      • Campture also contains links to websites, services, content and advertisements that we don’t own or control. We don’t necessarily endorse or assume responsibility for that stuff, either.
  4. Privacy

    Our Privacy Policy explains our collection and use of information on the service, including information you may consider personal. You consent to the information practices described in that policy as it may be updated from time to time.

  5. Security

    We take the security of Campture very seriously. We use reasonable practices to protect the security of your account and data associated with it, but we can’t guarantee that someone won’t be able to defeat our security measures. Please let us know immediately if you discover any compromise of your account.

    We are always on the lookout for security loopholes in Campture. If you discover vulnerability in our service, we would be grateful for your report and encourage you to let us know immediately. To report vulnerability, please email us at info@Campture.com.

  6. Copyright

    Campture has adopted the following policy toward copyright infringement on the Services in accordance with the Digital Millennium Copyright Act (the "DMCA"). The address of Campture's Designated Agent for copyright takedown notices ("Designated Agent") is listed below. You may submit a notice under the DMCA using our copyright notice form.

    Reporting Instances of Copyright Infringement:

    If you believe that Content residing or accessible on or through the Services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent at the address below:

    1. Identification of the work or material being infringed.
    2. Identification of the material that is claimed to be infringing, including its location, with sufficient detail so that Campture is capable of finding it and verifying its existence.
    3. Contact information for the notifying party (the "Notifying Party"), including name, address, telephone number, and email address.
    4. A statement that the Notifying Party has a good faith belief that the material is not authorized by the copyright owner, its agent or law.

    A statement made under penalty of perjury that the information provided in the notice is accurate and that the Notifying Party is authorized to make the complaint on behalf of the copyright owner.

    A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

    Please also note that the information provided in a notice of copyright infringement may be forwarded to the Subscriber who posted the allegedly infringing content. After removing material pursuant to a valid DMCA notice, Campture will immediately notify the Subscriber responsible for the allegedly infringing material that it has removed or disabled access to the material. Campture will terminate, under appropriate circumstances, the Accounts of Subscribers who are repeat copyright infringers, and reserves the right, in its sole discretion, to terminate any Subscriber for actual or apparent copyright infringement.

  7. Disclaimer of Warranties

    You expressly understand and agree that:

    1. You assume total responsibility and risk for your use of the Site and the Internet. Campture does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the Site, any merchandise, information or service provided through the Site or on the Internet generally, and Campture shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. The Site and any software made available on the Site are provided on an "as is, as available" basis.
    2. Campture makes no warranty that (i) the Site will meet your requirements or will always be accessible, (ii) the Site will be uninterrupted, timely, secure, error-free or free from computer virus or other invasive or damaging code, (iii) the results that may be obtained from the use of the Site will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations, and (v) any errors in the Site will be corrected.
    3. Any Content downloaded, uploaded or otherwise obtained through the use of the Site is done at your own discretion and risk. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Site or on the Internet generally.

    Campture has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Campture of the site. Use of any such linked web site is at the user’s own risk.

    Campture does not monitor or review the content of other party’s WEBSITES which are linked to from this website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by Campture and Campture should not be regarded as the publisher of such opinions or material. Please be aware that Campture is not responsible for the privacy practices, or content, of these sites. Campture encourages users to be aware when they leave the site and to read the privacy statements of these sites. Users should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site before disclosing any personal information to them. This Company will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from user disclosure to third parties of personal information.

  9. Termination

    Either party may terminate this Agreement at any time by notifying the other party. Campture may terminate or suspend your access to or ability to use any and all Services immediately, without prior notice or liability, for any reason or no reason, including but not limited to if you breach any of the terms or conditions of this Agreement. In particular, Campture may immediately terminate or suspend Accounts that have been flagged for repeat copyright infringement.

    Upon termination of your access to or ability to use a Service, including but not limited to suspension of your Account on a Service, your right to use or access that Service and any Content will immediately cease.

    All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability. Termination of your access to and use of the Services shall not relieve you of any obligations arising or accruing prior to such termination or limit any liability that you otherwise may have to Campture or any third party.

  10. Indemnity

    You agree to indemnify, defend and hold harmless Campture, its directors, officers, employees, suppliers, licensors, agents, and any third party Content providers, from and against any losses, damages, claims, costs, expenses, demands, and actions, occasioned by or howsoever arising out of your use of the Site, your access or connection to the Site, your violation of these Terms, or your violation of any rights of another. These obligations will survive any termination of your relationship with Campture or your use of the Site. Campture reserves the right to assume the defense and control of any matter subject to indemnification by you, in which event you will cooperate with Campture in asserting any available defenses.

  11. Limitation of Liability

    To the fullest extent allowed by law, Campture shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from (A) your access to, use of, inability to access or inability to use Campture; (B) any third party conduct or content on Campture, including any defamatory, offensive or illegal conduct of third parties; or (C) any unauthorized access, use or alteration of your content.

  12. Force Majeure

    No party shall be liable for any failure to perform its obligations under this Agreement if the failure results from a Force Majeure Event (defined below), provided always that whenever possible, the affected party will resume that obligation as soon as the Force Majeure Event occasioning the failure ceases or abates.

    For purposes of this Agreement, a “Force Majeure Event” is an event which is a circumstance or event beyond the reasonable control of a party which affects the general public in that party’s country or in the territory, and which results in the party being unable to observe or perform on time an obligation under this Agreement. Such circumstance or event shall include industrial action or labour disputes, civil unrest, war or threat of war, criminal or terrorist acts, government action or regulation, telecommunication or utility failures, power outages, fire, explosion, natural physical disasters, epidemic, quarantine restrictions, and general failure of public transport.

Nothing in this Statement shall prevent us from complying with the law. This Statement does not confer any third party beneficiary rights. We reserve all rights not expressly granted to you.
